Agreement Between Customer and Pass Drivers Ed LLC


Pass Drivers Ed LLC (www.passdriversed.com) (“Pass Drivers Ed,” “we,” “us,” or “our”) is a company that offers driver education courses and related services. The courses offered are informational and state-licensed, satisfying state laws for classroom driver education, to be used in obtaining a driver's license or meeting requirements mandated for traffic violations.


By using the services provided by Pass Drivers Ed, you are agreeing to be bound by the following terms and conditions (“Terms of Service”), in addition to the Site Terms of Use Agreement and Privacy Policy, which are expressly incorporated into these Terms of Service. In the event of any conflict between these Terms of Service and the Site Terms of Use Agreement or Privacy Policy, these Terms of Service will control.


In these Terms of Service, persons, legal guardians of persons, or entities that are enrolled in and/or receive services directly from Pass Drivers Ed are referred to as “account holder”, “user”, “Customer”, “Student”, “You”, or “Your.” These terms also refer to a person who is currently enrolled in a service or course provided by Pass Drivers Ed LLC.


Pass Drivers Ed reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, are subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at:



Violation of any of the Terms of Service may result in the termination of services provided to you by Pass Drivers Ed.


General Terms


You must be 13 years or older to use any service rendered via Pass Drivers Ed. Pass Drivers Ed does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use www.passdriversed.com and purchase services only with permission of a parent or guardian.


You must be a human. Students enrolled via the website by “bots” or other automated methods are not permitted. You must provide your legal full name, a valid email address, and any other information requested to complete the enrollment process form or other form submissions permitted via the www.passdriversed.com website.


Privacy and Security


Your use of www.passdriversed.com and our data collection practices are subject to our Privacy Policy.


Electronic Communications

Visiting www.passdriversed.com or sending email messages to Pass Drivers Ed and its employees constitute electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email or on the Site, satisfy any legal requirement that such communications be in writing.

Student Terms

As a Pass Drivers Ed student or legal guardian of a student, when purchasing a course that is licensed and certified to meet state requirements governing a given course, you certify by agreeing to these terms that you (or the student of which you are purchasing services on behalf of) are the minimum age required by that state to complete that course.

The student and account holder agrees that he or she will solely study and review the course material and complete all discussion questions and tests and no other person. If Pass Drivers Ed LLC, the course provider, determines that the student has purposely misrepresented himself or herself, has cheated, or otherwise in a manner providing false or misleading information, Pass Drivers Ed LLC will cancel the student's account and no refunds shall be given in any capacity. It is illegal to provide false information for state-licensed courses, meaning the student may also be prosecuted for perjury and possibly other criminal acts where punishable by law.

The student must complete the online class within 90 days. By state law, if 13 months pass after completing the course without the student taking behind-the-wheel sessions, the student must take a 10 hour classroom refresher course. If a student fails the online course due to not completing in the time allowed and outlined on the course home/start page (failed due to expiration), the student will have to purchase a $30 extension to finish completing the course.

Course Package-Specific Terms

For ALL offered course packages: These terms constitute the entire agreement between the school and the customer or student and no verbal statement or promises will be recognized.

Online Failure To Yield Package: Upon completion of this course, Pass Drivers Ed will notify the DMV with proof of completion. The student must successfully complete the online course as well as the final test to receive proof of completion. Upon submission, the student should check his or her driving status and eligibility to reinstate operating privileges (if the student has been suspended) at wisconsindot.gov. All students must complete the entire course within 12 months or will be subject to additional fees.


Cancellation/Refund Policy


Pass Drivers Ed will NOT refund any payment or tuition (or part of payment or tuition) IF Pass Drivers Ed is ready, willing, and able to fulfill its part of this agreement.


If you choose to stop accepting services provided by Pass Drivers Ed, Pass Drivers Ed is not obligated to provide further access to a provided online course, and may immediately discontinue access to any online course as administered via www.teachsafe.com (Teach Safe, LLC). You also acknowledge and agree that Pass Drivers Ed may delete course status and related information from the Teach Safe online course service.


Maintenance and Service Interruption


You acknowledge that required periodic or emergency maintenance of the Pass Drivers Ed website (Site) may result in the Site being unavailable temporarily. Emergency maintenance may occur without warning. In addition, third-party services, such as e-mail transmission, payment processing, or web hosting, may experience an outage causing the Site not to operate as expected, resulting in temporary loss of service through the Site. Pass Drivers Ed will make every effort to notify students and parents of scheduled and unscheduled maintenance in cases where it may affect their service, but makes no warranties regarding the length of time the Site may be down.


Third Party Services


Certain services made available via www.passdriversed.com / Pass Drivers Ed are delivered by third-party sites and organizations. By using any product, service, or functionality originating from the www.passdriversed.com domain, you consent to Pass Drivers Ed’s sharing of information and data with the third-party service provider. You also agree that these sites and organizations and their practices are not under the control of Pass Drivers Ed, and that Pass Drivers Ed is not responsible for the contents of any site or those provided by an organization, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site, or the third parties provided services. Pass Drivers Ed has partnered with Teach Safe (https://www.teachsafe.com) to help us build and offer course packages that include an online/web-based course that may be completed over the internet. When enrolling in an online course package through Pass Drivers Ed, your enrollment information is automatically used to generate a student user account in the Teach Safe website as part of our package offering. Both companies may share data between them, with the exception of any payment-related information, but only so that they may contact you or send you information on services provided by them that may be of value or interest to you as the consumer. We strongly encourage you to review its Privacy Policy and Terms prior to enrollment in our online course packages.


No Unlawful or Prohibited Use/Intellectual Property


You are granted a non-exclusive, non-transferable, revocable license to access and use www.passdriversed.com strictly in accordance with these Terms of Service. As a condition of your use of the Site and provided services you warrant to Pass Drivers Ed that you will not use the Site, services, and related materials for any purpose that is unlawful or prohibited by these Terms of Service. You may not use the Site, services, and related materials in any manner which could damage, disable, overburden, or impair them or interfere with any other party’s use and enjoyment of the Site, services, and/or materials.


You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site or course materials. Pass Drivers Ed content is not for resale. Your use of the Site, services, and materials does not entitle you to make any unauthorized use of any protected content. You shall not alter any proprietary rights or attribution notices in any content. You will use protected content solely for your use and will make no other use of the content without the express written permission of Pass Drivers Ed and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Pass Drivers Ed or our licensors except as expressly authorized by these Terms of Service.


International Users


All services rendered are controlled, operated, and administered by Pass Drivers Ed from our offices within the USA and not intended for international use at this time. You agree that you will not use the Pass Drivers Ed Content accessed through www.passdriversed.com or its online courses administered on its behalf via the www.teachsafe.com (Teach Safe, LLC) website in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.


Indemnification


You agree to indemnify, defend, and hold harmless Pass Drivers Ed, its officers, directors, employees, owners, affiliates, attorneys, accountants, agents and third parties, from and against any claim, suit, demand, loss, liability, damage, action, or proceeding arising out of or relating to: (i) your breach of any provision of these Terms of Service, or (ii) your use of the Service in a manner that is illegal, violates applicable law, or is inconsistent with these Terms of Service.


Liability Disclaimer


In addition to all other waivers, disclaimers, and limitations in these Terms of Service, we will not be liable for: any interruption, malfunction, downtime or other failure of the Site or website-provided services, our system, databases, or any of its components, for whatever reason; any loss or damage arising from any action on your part based on the information provided on the Site; any loss or damage to End User data or other data directly or indirectly caused by malfunction of our system, third-party systems, power failures, unlawful access to or theft of data, computer viruses or destructive code on our system or third- party systems; programming defects, or negligence on our part; any interruption, malfunction, downtime or other failure of goods or services provided by third parties, including, without limitation, third-party systems such as the public switched telecommunication service providers, internet service providers, electricity suppliers, local authorities, other certification authorities, and third party company services we provide access to as part of our services; any event over which we have no direct control.


The failure of Pass Drivers Ed to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Pass Drivers Ed and govern your use of the Service, superseding any prior agreements between you and Pass Drivers Ed (including, but not limited to, any prior versions of the Terms of Service).


In no event shall Pass Drivers Ed’s liability to you exceed the amount you have paid to Pass Drivers Ed during the 12 months preceding your notice to Pass Drivers Ed of its alleged liability.


Choice of Law and Venue


These Terms of Service are entered into in the State of Wisconsin in the United States of America and shall be governed by and construed in accordance with the laws of the State of Wisconsin, exclusive of its choice of law rules. Each party to these Terms of Service submits to the exclusive jurisdiction of the state and federal courts for Washington County, Wisconsin, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any action to enforce these Terms of Service, the prevailing party will be entitled to costs and reasonable attorney's fees.


Miscellaneous Provisions


You agree that no joint venture, partnership, employment, or agency relationship exists between you and Pass Drivers Ed because of these Terms of Service or use of the www.passdriversed.com website.


If any part of these Terms of Service is determined to be invalid or unenforceable pursuant to applicable law, including the limitations on liability set forth above and the warranty disclaimers set forth in the incorporated Site Terms of Use, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.


Unless otherwise specified in these Terms of Service, these Terms of Service constitute the entire agreement between you and Pass Drivers Ed; it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Pass Drivers Ed.


A printed version of these Terms of Service and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms of Service to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.


This constitutes the entire agreement between the school (Pass Drivers Ed) and student and no verbal statement or promises will be recognized. This school will not refund any tuition or part of tuition if the school is ready, willing and able to fulfill its part of the agreement
