TERMS OF AGREEMENT
Pass Drivers Ed, hereinafter referred to as "The Driving School" agrees to provide applicant, hereinafter referred to as "Student", 24 hours of online classroom instruction based on the Ohio Driver Training Curriculum.
REGULATION GOVERNING NUMBER OF HOURS TO BE COMPLETED IN A 24 HOUR PERIOD
Regulations prohibit more than 4 hours of training to be conducted in one day.
REGULATION GOVERNING COURSE BREAKS
Ohio regulations require all students to take a 10-minute break after 2 hours of continuous instruction. Students may resume their course after 10 minutes has elapsed.
TUITION
The tuition for said instruction is $69.95.
ELIGIBILITY TO BEGIN INSTRUCTION
The student must be 15 years and 5 months old to begin this course. The student may begin online classroom instruction before obtaining a temporary driving permit.
COURSE APPROVAL AND THIRD-PARTY DATA ACCESS
The Driving School must authenticate the identity of the student’s guardian to comply with state identity verification requirements. Identity will be authenticated electronically based on information the guardian provides during registration, including name, address, and phone number. Parent/guardian may be required to provide state-issued photo ID to authenticate their identity.
DISMISSAL POLICY
Should it be determined that anyone other than the student has completed any portion of the course, the student will not be allowed to move forward with their course, a certificate of completion will not be issued, and no refund will be given.
REFUND POLICY
In general, the Driving School will not refund any payment or tuition (or part of payment or tuition) if the Driving School is ready, willing, and able to fulfill its part of this agreement. If the Driving School offers a refund in extenuating circumstances, the Driving School may deduct an administrative fee up to $50 from the refund provided.
COURSE CHANGES
The Student and/or their Parent/Guardian is responsible for determining the appropriate course for their needs. If the Student enrolls in the wrong course and needs to change to another course offered by the Driving School, a $20 Course Change fee will apply. No refunds or price adjustments to course fees will be made.
PROHIBITED BEHAVIOR
You agree not to use the Service in any way that is threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, or any similar behavior. Such behaviors include written or verbal abuse, threats, or harassment of our employees by any means.
You must not upload any content to our website or management platform or email to our staff any content or links to third party websites containing content which falls into any one or more of the following categories:
(a) contains confidential information belonging to any other person, save and except where you have the legally binding authorization of such person to upload the content to our website; (b) contains any advertising or promotions relating to any other business or that provides a link to any other business, without our prior written consent; (c) is deceptive, dishonest, deceitful, inaccurate or untrue; (d) misrepresents your identity, status or any affiliation you may have with any third party; (e) impersonates any other person or organization; (f) contains any swear word or profanity, is offensive, obscene, hateful or aggressive, threatening, abusive, harassing or malicious towards any person or is likely to cause anxiety, distress, discontent or annoyance, or which promotes violence, hatred, aggression or unrest; (g) is in any way discriminatory towards any person or class of persons on account of nationality, race, gender, age, religion, disability, sexual orientation or any other characteristic or ground(s) capable of constituting unlawful discrimination; (h) infringes any intellectual property rights of any other person, including, without limitation, any copyrights, database rights or trademarks; (i) is defamatory, disparaging, rude or insulting towards any person or organization or which is capable of harming the reputation of any person or organization; (j) contains, alludes to or describes any sexually explicit material, or which redirects users to such content; (k) incites, encourages, advocates or promotes any illegal activity, or assists anyone in the commission, planning or conduct of any illegal activity; or (l) contains a statement that is likely to be understood by some or all of the members of the public to whom it is published as a direct or indirect encouragement or other inducement to them to the commission, preparation or instigation of acts of hatred, violence or terrorism.
If you engage in prohibited behavior, your account will be suspended, and you will be provided with an opportunity to appeal the account suspension. In the case of a successful appeal, no course extensions will be made to account for the period of suspension. Pass Drivers Ed may, at its sole discretion, permanently suspend your account. In the case of a permanent suspension, no refund of course fees will be made.
LENGTH OF TRAINING
The Student is required to complete all available training within 90 days from their first day of training. If the course is not complete within the initial 90 days, the student may extend their course access in 30 day increments for an additional $30 fee per extension. Course extensions may not exceed 180 days from the initial date of training. No refunds will be issued for students who do not complete their course within the required amount of time. If the course has not been completed within the required amount of time, the Student may re-take the course from the beginning, after providing a $30.00 Reenrollment Fee payment.
Per the Ohio Administrative Code 4501-7-09 (8) “All training as required in this rule and rule 4501-7-10 of the Administrative Code, provided by the enterprise shall be made available to, and completed by, the student within six months of the first date of training, unless mitigating circumstances occur. Mitigating circumstances include health and family issues that disrupt the student's ability to receive training. Mitigating circumstances do not include the inability to schedule training due to parent or student elective or extra-curricular activities, such as sports and school clubs. Mitigating circumstances shall be documented in the student's record. Requests for special circumstances not listed to be considered as "mitigating" shall be requested through the department. If no mitigating circumstances are approved, training will be voided and the student shall re-take the training.”
ACCOUNT INACTIVITY
If the Student does not have any account activity for sixty (60) days, the account will be automatically inactivated. The student may contact The Driving School to request reactivation. If the request is received after 90 days from the first day of training but before 180 days, the Student must purchase a course extension before the account can be reactivated.
HARDWARE, SOFTWARE, AND SKILL REQUIREMENTS
An internet-capable device such as a smartphone, tablet, laptop, or desktop PC is required to successfully complete the course. A stable and continuous internet connection is required. The latest version of the device’s operating system and internet browser are required. An understanding of basic computer hardware and software with the ability to perform computer operations, as well as knowledge of basic computer and internet terminology will be required to take the course. Access to a functioning email inbox is also required.
INTERRUPTIONS IN COURSE SERVICE
Interruptions in course service may occur that The Driving School has no control of. The Driving School will work diligently to restore access if the course service is disrupted.
EXPIRATION OF AGREEMENT
This agreement expires six months from the date the contract is signed. If the student does not complete their training within six months, the training shall be voided. If the course has not been completed within 180 days from the date the contract is signed, the Student may re-take the course from the beginning, after providing a $30.00 Reenrollment Fee payment.
DRIVERS LICENSE NOT GUARANTEED
The Driving School does not guarantee the issuance of a driver's license to the student.
CANCELLATION OF AGREEMENT
The Driving School reserves the right to cancel this agreement at any time, should the Student's conduct indicate a lack of responsibility deemed necessary by The Driving School. Should this agreement be cancelled under such circumstances, all fees may be pro-rated, based upon hours of services provided prior to cancellation.
COMPLETION CERTIFICATE
The Driving School shall furnish a certificate of completion to all students under the age of eighteen years, who successfully complete the course. Completion, as defined by the State of Ohio, refers to the completion of the required number of hours and the attainment of a score equal to 75% on the performance measurement.
SECURITY AND PRIVACY POLICY
As required by the state of Ohio, The Driving School maintains an electronic record of the student’s personal data in a secured system.
COMPLETION CERTIFICATE RE-ISSUANCE POLICY
If it is necessary to reissue a completion certificate due to the student providing incorrect information, student will be charged a $10 Re-Issuance Fee.
Commercial Driving schools are licensed by the Department of Public Safety through the Driver Training Program Office, 1970 West Broad Street, Columbus, Ohio 43223.
