Driver Education Program
This Student Registration Terms and Waiver Agreement is made between NC Driving 101 LLC (“NC Driving 101,” “School,” “we,” or “us”) and the registering student and, if the student is under 18, the student’s parent or legal guardian (“Student,” “Parent/Guardian,” or “you”).
By completing registration, submitting payment, and electronically signing or acknowledging these terms through the student account, the Student and Parent/Guardian agree to the following terms.
Tuition must be paid in full before the Student may begin the course unless other written arrangements have been approved by NC Driving 101.
Payment may be made by credit card, debit card, personal check, money order, or cash. A $35.00 service charge will apply to any returned, cancelled, or insufficient-funds payment.
Refunds are subject to the following policy:
If registration is cancelled at least two full working days before the first class meeting, tuition may be refunded less a $150.00 processing/administrative fee.
If a refund request is made less than two full working days before the first class meeting, the Student may receive a refund equal to 50% of the paid classroom tuition.
No refund will be issued for any portion of tuition once services have been rendered.
If a behind-the-wheel session is cancelled at least 24 hours before the scheduled appointment, the session fee may be refunded less a $150.00 processing/administrative fee.
If a behind-the-wheel session is cancelled less than 24 hours before the scheduled appointment, no refund will be provided.
Cancellation of special testing appointments must be made at least 24 hours before the scheduled appointment. A $50.00 fee may be charged for cancellations made less than 24 hours before the appointment.
North Carolina state law requires students to complete 30 hours of classroom instruction. Students must complete all required classroom instruction to receive a Driver’s Training Certificate.
Students are expected to arrive on time and remain present for the full class period. If a Student arrives late, leaves early, or misses class time, that time may be counted as an absence. Missed classroom time must be made up during another available session. Makeup dates and locations are subject to availability and are not guaranteed.
A Student who misses too many required classroom hours may be required to retake the full classroom portion of the course at the current class rate. A re-enrollment fee may apply if the course is not completed or if required class time is missed.
A $25.00 fee will be charged for replacement of a lost end-of-class or completion certificate.
NC Driving 101 will make reasonable efforts to complete the course in a reasonable period of time. However, NC Driving 101 is not responsible for delays caused by mechanical failure, unsafe driving conditions, instructor illness, weather, government action, scheduling limitations, technology issues, or other circumstances outside of the School’s reasonable control.
Upon successful completion of all required portions of the program, the Student will receive the applicable certificate or certificates of completion.
NC Driving 101 does not guarantee that the Student will pass any North Carolina Division of Motor Vehicles written test, traffic sign test, road test, permit exam, license exam, or other DMV requirement.
Students are expected to behave respectfully toward instructors, staff, and other students.
The following may result in removal from class, cancellation of a lesson, dismissal from the program, and/or forfeiture of fees paid:
Profanity, harassment, threats, abuse, or disruptive behavior;
Use or suspected use of alcohol, illegal drugs, impairing prescription medication, marijuana products, vaping, smoking, or other substances before or during class or driving instruction;
Appearing impaired, unsafe, unfit, overly tired, distracted, or otherwise unable to participate safely;
Violation of classroom, virtual classroom, or behind-the-wheel safety rules;
Misuse of course materials, technology, or login information.
Parent/Guardian and Student agree to notify NC Driving 101 of any medical, physical, mental health, learning, vision, hearing, or other condition that may affect the Student’s ability to safely or successfully participate in classroom instruction, virtual instruction, testing, or behind-the-wheel training.
Examples may include, but are not limited to, diabetes, epilepsy, amputation, paralysis, hearing impairment, vision impairment, use of corrective lenses, attention deficit disorder, learning disabilities, or any condition that may affect driving performance or classroom participation.
If any portion of the course is held virtually, NC Driving 101 may use Zoom or another video conferencing platform.
Students must attend using their own single point-of-use device and may not share the device or login with another participant. Students may be required to keep their camera on for the entire class period, except during scheduled breaks.
Cell phone use is prohibited during virtual classroom instruction except as expressly permitted by the instructor or required for participation in the virtual class.
Students may not share webinar, meeting, or login information with anyone who has not registered and paid for the course.
All course materials, online course content, instructional materials, handouts, presentations, videos, and related materials are the intellectual property of NC Driving 101 or its licensors.
Students and Parent/Guardian may not copy, modify, reproduce, republish, sell, sublicense, upload, broadcast, post, transmit, distribute, record, or use course materials for any other course or training purpose without prior written permission from NC Driving 101.
Students may not remove copyright notices or other ownership notices from any NC Driving 101 materials.
If the Student is registered for behind-the-wheel training, tuition for that portion must be paid in full before driving instruction begins unless it has already been paid as part of the full program.
Before the Student may drive with an instructor, the Parent/Guardian, Student, and NC Driving 101 representative must complete all required documentation, including the SBTS-800 / Restricted Instruction Permit, if applicable.
Driving appointments are scheduled based on instructor availability, weather, state requirements, student readiness, and payment status.
Students must complete the required behind-the-wheel training with NC Driving 101 to receive the applicable Driver’s Training Certificate.
Cell phones are prohibited during behind-the-wheel training and must be turned off or set to Do Not Disturb While Driving.
If additional driving time is needed or requested, additional sessions may be scheduled at the current hourly rate.
During behind-the-wheel instruction, the Student must follow all instructor directions and operate the vehicle in a reasonably safe manner.
This includes, but is not limited to, obeying traffic signals and signs, checking blind spots, yielding properly, staying in the proper lane, obeying posted speed limits, and following all applicable laws and safety instructions.
Student and Parent/Guardian may be responsible for damage to NC Driving 101 materials, equipment, or vehicles caused during the course of instruction to the extent permitted by law.
Dashboard cameras may be used during behind-the-wheel lessons. By agreeing to these terms, Student and Parent/Guardian acknowledge and agree that dashboard camera footage may be used for safety, training, documentation, or administrative purposes.
Photos or videos may also be taken for advertising or promotional purposes. By agreeing to these terms, Parent/Guardian acknowledges awareness that the Student may be photographed or recorded. Parent/Guardian may contact NC Driving 101 in writing with any concerns regarding promotional use.
NC Driving 101 will use reasonable efforts to teach the Student the skills and information needed for driver education and applicable North Carolina DMV requirements. However, NC Driving 101 does not guarantee that the Student will pass any DMV test, obtain a permit, obtain a license, or perform safely in future driving.
NC Driving 101 is not responsible for the Student’s future driving performance after completion of the program.
NC Driving 101 is not liable for delay, cancellation, rescheduling, or inability to provide services due to circumstances outside its reasonable control, including but not limited to weather, unsafe road conditions, mechanical failure, fire, flood, natural disaster, terrorism, strikes, transportation disruptions, instructor illness, family emergency, government order, regulation, or other unforeseen circumstances.
NC Driving 101 is licensed by the State of North Carolina, Division of Motor Vehicles and School Bus Traffic Safety Section.
To the extent permitted by law, Student and Parent/Guardian agree to indemnify and hold harmless NC Driving 101 from damages, expenses, fees, fines, claims, or other amounts arising from the acts or omissions of the Student.
Student and Parent/Guardian acknowledge that this indemnification provision is an important part of this Agreement.
These terms constitute the entire agreement between NC Driving 101, the Student, and the Parent/Guardian regarding the Student’s registration and participation in the program. Any verbal assurances, statements, or promises not included in these terms are not binding unless confirmed in writing by NC Driving 101.
By registering through the student account, electronically signing, checking an acknowledgment box, or otherwise submitting registration, Student and Parent/Guardian confirm that they have read, understand, and agree to these Student Registration Terms and Waiver.
Student may not attend class or begin training until required registration forms are completed and all required fees are paid.
