Drive Right, LLC Student Contract


Online Classes

Students will complete 30 hours of online classes within 65 days after beginning the first lesson. . If a student fails to complete the classes within 65 days, the course will expire. Students may extend the course an additional 30 days for a $65 fee. Students may complete lessons when convenient to their schedule. Students may complete up to 3 hours of lessons per day.


Driving Lessons

Students will complete all driving lessons, assignments, and evaluation within 45 days of beginning the course.


Refund Policy

A cancellation fee of $75 will be charged if you choose to cancel out of the course before beginning the first lesson within 24 hours of registering. The refund amount would be $224. Once you have begun the online course or past 24 hours from submitting the registration, no refunds are issued.


Grading and Progress Policy

Students will complete 30 online lessons. Students must pass evaluations within each lesson to progress to the next lesson Students must pass driving lessons and successfully complete the driving Evaluation. Failure to pass the driving evaluation will require a retest with a Drive Right Instructor or a required driving test with the Iowa Department of Transportation, determined by the Drive Right Instructor.


Rules of Operation and Conduct

A student or prospective student may be dismissed or barred from the class for tardiness, drunkenness, or consumption of alcohol or drugs on the premises; rude, vulgar or disruptive behavior in the classroom; smoking in the classroom; or being generally inattentive (sleeping, reading, etc.) during class. Students terminated for

violating Rules of Conduct may be readmitted at the discretion of the School Director.


Additional Terms of Agreement

A. If the Student is a no-show, late, or fails to cancel at least twenty-four (24) hours in advance of a scheduled driving lesson, the student will be charged $50.00 for missing a behind-the-wheel lesson.


B. The Student must have proper license (your permit) in his or her possession for any behind-the-wheel lesson, or the lesson will be canceled and the student will be charged $50.00. Also, proper shoes (no flip-flops or open sandals) MUST be worn, or driving may be canceled and a $40.00 fee may be charged.


C. The School’s authority in issuing a certificate of completion will not be compromised, therefore, the School does not guarantee the student passes the course. Additional proof of mastery must be shown at Student’s expense of $50.00 for each additional lesson.


D. The School reserves the right to reschedule a driving lesson in the event of inclement weather, unavailability of the instructor, or any other factor beyond the School’s control.


E. The School and Student agree that the terms of this Contract shall be from the day of registration to One year or 365 days thereafter for both the Classroom Instruction and Behind-The-Wheel Instruction. After 365 days, any new state requirements or change in school fees will apply. In addition, the Student must repeat the entire Driver Education Course at the prevailing price.


F. Cell phone use is not permitted. If a student is found using a cell phone, the phone will be confiscated and returned to the student only at the end of class or lesson.


G. A $40.00 fee will be charged for any returned check which the School accepts as payment for Student tuition or fees.


H. The Student, parent or guardian certifies that he or she has read and understands this Contract.


I. The School is prohibited from issuing a certificate of completion if the Student has not met all of the requirements for course completion and the student should not accept such a certificate under those circumstances.


J. This driver education School maintains commercial vehicle insurance as required.


K. The student will complete online classes and driving components within the parameters set forth by Drive Right, LLC.


L. For in-person classes, students must attend all classes. Any absence will be required to be made up with an online class with a $65 fee.

Each party to these Terms and Conditions submits to the exclusive jurisdiction of the state and federal courts for Washington County, Wisconsin, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any action to enforce these Terms and Conditions, the prevailing party will be entitled to costs and reasonable attorney's fees. Entire Agreement

These Terms and Conditions constitute the entire agreement between Driving School GM and you pertaining to the subject matter of this Agreement. In its sole discretion, Driving School GM may modify these Terms and Conditions by posting the revised version on this Site and you agree that each visit by you to this Site is a new transaction governed by the terms of use linked on this Site at that time.

No Unlawful or Prohibited Purpose

Driving School GM is a company that provides software tools for driving schools to manage the business operations of a driving school, which may include student data and scheduling. These companies are referred to as “Customer Schools” in this Privacy Policy. By your use of the Site or otherwise providing your personal information through the Site, you agree to the terms and conditions of this privacy policy and any updates we make. Our Terms of Use Agreement takes precedence over any provision conflicting with our Privacy Policy. This is our complete Privacy Policy and supersedes all earlier versions. It is our policy to use the personally identifiable information we acquire through our Site for internal business purposes only and to provide content, products, and services that you value and that our Customer Schools or you request. We may share any information obtained through this Site with Customer Schools. Except for this sharing, and except as required by law or as necessary to fulfill your request for products or services, we do not authorize the use of your personal information by any third party and do not sell your personal information to anyone. We operate and maintain a variety of online security measures to safeguard and keep your information private.

Information Collection and Use

We gather two types of information: (1) personally identifiable information that you supply voluntarily when you order products or services from us or Customer Schools or create a profile; and (2) aggregate tracking and site usage information that we gather automatically as you access our Site.

WE DO NOT COLLECT, ACCEPT, OR STORE PERSONAL INFORMATION REGARDING INDIVIDUALS LOCATED IN THE EUROPEAN UNION. If you are located in the European Union, you are not authorized to provide any personal information to us in any manner, whether through the Site or otherwise.

Anyone can access our Site, but there are certain areas and services that require registration or providing certain personal information if accessed, such as by creating a profile and purchasing products or services. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Driving School GM website.

By using this Site, you expressly consent to this sharing of your non-public personal information with Customer Schools and governmental agencies.

Driving School GM may also use your personally identifiable information to inform you of other products or services available from Driving School GM, its Customer Schools, and affiliates. Driving School GM may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

Driving School GM does not sell, rent, or lease its customer lists to third parties.

Driving School GM may share data with trusted partners to help perform statistical analysis, send you email, or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Driving School GM, and they are required to maintain the confidentiality of your information.

In addition to those disclosures expressly described elsewhere in this Privacy Policy, Driving School GM will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Driving School GM or the site; (b) protect and defend the rights or property of Driving School GM; and, (c) act under exigent circumstances to protect the personal safety of users of Driving School GM or the public.

Do Not Track

Driving School GM tracks its customers over time, but not across third party web sites and not to provide targeted advertising, and therefore does not respond to Do Not Track (DNT) signals. Driving School GM does not track its customers across third-party websites. The Site does not accept incoming requests that are insecure. Such requests will be upgraded to use SSL to ensure data transmission security. Furthermore, Driving School GM ensures that user passwords are not stored by or accessible to Driving School GM or its employees. Furthermore, while Driving School GM makes every effort to keep user and Customer School information secure, it is ultimately the responsibility of the user and Customer School to keep user and Customer School information safe and secure by adopting sound data security practices, including not sharing the information with unauthorized parties.

Third Party Services

www.drivingschoolgm.com’s Customer Schools use a PCI-compliant third-party service such as Stripe.com (“Stripe”), Authorize.NET, and PayPal to process charges made to student accounts. At no point does credit card information come into contact with www.drivingschoolgm.com servers, nor is stored with www.drivingschoolgm.com. For those using Stripe.com, Stripe.com handles all aspects of the payment processing and storage on Driving School GM’s or the Customer School’s behalf, and only operates via encrypted communication using SSL/https. Stripe has been audited by a PCI- certified auditor and is certified to PCI Service Provider Level 1. This is the most stringent level of certification available. As outlined in our Terms, Driving School GM collects payment information only from Customer Schools; it does not collect payment information from other users, including students and guardians. A Customer School may use technology available to it through Driving School GM to facilitate the payment process from a student to the school. Driving School GM is not a party to such transactions and will retain no information regarding the transaction. Driving School GM only provides software services and tools to the Customer School, which the Customer School may use to create an end user/student account.

Children Under Thirteen

Driving School GM does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website.

Changes to This Statement

We may modify this privacy policy at any time, so please review it frequently. We will post any changes to the privacy policy on the Site, but we have no other obligation to notify you of such changes. We indicate the date of the current version of this privacy policy below, so you know when it was last updated.
